By accessing or using the Chargetect website and services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.

Chargetect provides an automated software tool that utilizes artificial intelligence to generate evidence documents (PDFs) intended to assist merchants in responding to chargeback disputes.
Scope of Service: The Service is limited to the formatting and generation of documents based on data provided by you. We do not represent you in any dispute process, interact with banks on your behalf, or provide legal representation.
Chargetect offers a Money-Back Guarantee strictly limited to the purchase price paid to Chargetect for the service (e.g., $15.00).

Prohibition on Manipulation: You agree not to submit altered, Photoshopped, or fabricated screenshots to our Refund Claim system. We utilize advanced AI forensic tools to detect manipulation. Any attempt to defraud our refund system will result in:
• Immediate permanent ban from the Service.
• Reporting of your activity to relevant fraud databases.
Your Data: You retain all ownership rights to the data and evidence you upload. You grant us a worldwide, non-exclusive license to use, reproduce, and process this data solely for the purpose of providing the Service and improving our AI models.
The Service may integrate with third-party providers (e.g., Stripe, OpenAI). We are not responsible for the availability, performance, or errors of these third-party services.
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. EXCEPT FOR THE SPECIFIC MONEY-BACK GUARANTEE OUTLINED IN OUR REFUND POLICY, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
No Guarantee of Outcome: We do NOT guarantee that you will win your dispute or that the AI-generated "Statement of Facts" will result in a victory. The Service is an automated tool designed to provide you with a complete, professional evidence packet to assist you in fighting your dispute. The final decision rests solely with the banking institutions involved.
IN NO EVENT SHALL CHARGETECT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including attorneys' fees, arising out of your use of the Service or breach of these Terms.
These Terms shall be governed by the laws of the State of Delaware, United States. Any legal action related to this Service shall be brought exclusively in the courts of Delaware.
